It is not being thought as an option now but you never know in the future. It has been stated that DS plans on using it's current theme for at least the next 2 or 3 years so it will more than likely not be released unless or until they decide to change to another theme.

isnt there a big risk though that the rip off sites will steal it and sell it? I imagine a theme this fresh and professional looking would be extremely popular

Oh man, this discussion is so passé. There will always be that risk the minute you publish your work on the web. DS and every other designer/artist knows that. What do you expect them to do about it? Stop creating themes for us and/or close down this site?

People have ripped DS's themes in the past and DS has stayed on so, it doesn't matter.
